If I don't make mistake for above software, this is voice mailbox function, not recording the voice of the speaker from the other side of the phone during talking in the phone.
only illegal in some states. some states allow recording of conversations with 1 party's permission. you being the one party is sufficient.

But there are other territories where RIM sell product. My guess is that this feature has been left out on purpose. Imagine the lawsuits.
oh im sure, not to mention the enormous amount of data space it would need to store the calls.. it definitely would be an awesome 3rd party app though..
All my Samsung flip phones had this feature, Samsung hasn't been sued yet... and they didn't take any more room up than a standard VoiceNote on the Curve does.
