If you can prove to the CS that it IS in fact a manufacturers issue, then you may be able to get it replaced.

If it's a defect, RIM has a one year warranty. But I'd try to get to replaced before going through RIM."In God we trust....all others we investigate".

ive always been able to go through my carrier for manufacture defects before the one year of purchase ended.Apple iPhone 5 - iOS 6
