Return policy question!

I just purchased an HTC Surround about 15 days ago and I'm thinking of returning it and getting a torch. Only problem is I have a small scratch on the corner of the phone will this automatically void my return policy or can I pay some kind of return fee ??? Please help.

I have always had a windows phone from the htc tilt to the fuze to the pure and now have the bb torch if u would wanna trd phone we could do so my torch is a few months old
