Hi - can you somehow share a picture of the screen? Perhaps using a separate handset or your webcam?
What sort of device is it? ( Model? Carrier? )
It's a Blackberry Curve 3g 9300 on O2. I am struggling to know how to attach a photo to this reply.

No it is like a user agreement for the Rim Software and it is obvious the phone is working behind it but unfortunately we cannot remove it. I am at a loss I wonder if the track pad is faulty?
Try hitting the enter key on the keyboard instead of the trackpad to confirm the message.
That won't do it either it's all I need to do is click select
Sounds like you may have nailed it with the bad trackpad. You have to accept the RIM software agreement by scrolling through it and hitting OK. Its a 10$ part on ebay.
